The Contents of our Website are intended solely for personal, noncommercial use by the users of our Website. You may download or copy the Contents displayed on our Website for your personal, noncommercial use only so long as your copy retains any copyright and trademark notices appearing on our Website. No right, title, or interest in any downloaded materials is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents or the Website.

    Occasionally there may be information on the Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Website is inaccurate at any time without prior notice (including after you have submitted your order).

    We have made every effort to display as accurately as possible the colors of our products that appear at the Website. However, since the actual color you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.

  6. Comments, Feedback and Other Submissions

    We welcome your comments and feedback regarding our Website, our products, and our services. We do not, however, accept confidential or proprietary information. Accordingly, all comments, feedback, ideas, suggestions disclosed, submitted or offered to The Company using this Website (including the chat room) or otherwise (collectively, "Comments"), are not confidential and will become and remain The Company's property. The disclosure, submission or offer of any Comments constitutes an assignment to The Company of all worldwide rights, titles and interests and goodwill in the Comments without payment of any compensation. Comments submitted by you must not violate any right of any third party, and must not contain any libelous, abusive, obscene or otherwise unlawful material.

    You will not post any Comment that (a) is defamatory, abusive, harassing, threatening, or an invasion of a right of privacy of another person; (b) bigoted, hateful, or racially or otherwise offensive; (c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms or can reasonably be expected to harm any person or entity,

    All Comments must be true, and in accordance with the rights of privacy and publicity and all federal, state and international law. You may not upload an image or any likeness of another without their consent (or the consent of their parent or guardian if they are under the age of 18). If you do so, The Company reserves the right to cancel or suspend your account. Furthermore, The Company reserves the right to cancel or suspend your account, if in its sole discretion, it believes you are using The Company for improper purposes, or any purpose inconsistent with its business.

  7. CHILDREN

    The Company does not accept Comments from persons under the age of 13 ("Child" or "Children"). Furthermore, The Company does not accept any user who is a Child. You are ineligible to use this Website if you are under the age of 13. If you are under the age of 18, you must have your parent or legal guardian set up your account and have them agree to these terms. If you are under the age of 18, your parent or legal guardian's consent to these terms is ongoing and they hereby warrant that they will review these terms for changes, and if any occur, that they will be amenable thereto until you reach age 18, at which point you hereby give your consent to these terms. Furthermore, to the extent any user under the age of 18 makes a Submission of copyrighted materials heretofore, their parent or legal guardian hereby grants The Company all rights to utilize the copyright and image / likeness embodied therein as further enumerated in these Terms of Use.

  8. Returns and Exchanges

    All Drop Ship Superstore orders are final sale, there are no returns or exchanges on any items ordered.

    The Drop Ship Superstore sells wholesale dropshipping items in quantities starting as low as single pieces. We provide our massive catalog in a very low pricing format and as low as 1 piece per style so that our customers can easily provide their customers a huge array of different styles, even with a no to small budget. We strive to ensure that all of our women's fashion, leggings and products are of the very best quality for the prices that are displayed and we will not provide sub-par quality products.

    For manufacturer defective item(s), you have 2 days from the day of delivery to notify us of any defective item(s). The Drop Ship Superstore may request images of the defected item(s) to verify any issues. In most cases, the Drop Ship Superstore will provide a store credit to use on your next order and not replace the defective item(s). 

    NOTE: All "Refused" and "Return to Sender" packages will have a 30% restocking fee applied. Shipping fees are NOT refundable.

    NOTE: ORAL MEDICAL MASKS, FACE MASKS (ANY SORT OF AIR FILTRATION ITEM), PERSONAL PROTECTION DEVICE, SANITIZER OR ANY OTHER ITEM RELATED TO PERSONAL HEALTH AND ORAL AIR FILTRATION CANNOT BE RETURNED UNDER ANY CIRCUMSTANCE DUE TO THE NATURE OF PERSONAL PROTECTIVE ITEM AND HEALTH RULES LAWS AND GUIDELINES.

  9. Shipping Charges
    WE ARE NOT RESPONSIBLE FOR ANY SHIPPING DELAYS BY USPS, UPS or FEDEX. We have no control over the service levels provided by them.  We pick, pack and ship your order as fast as possible and deliver your package to one of the shippers based on your preference.  These are large independent shipping companies whose service is independent of our ability to control.  We assume no responsibility for these company's service levels or delays.
    When Does Your Order Ship

    At the Drop Ship Superstore, we will begin working on your order within 30 minutes of you placing it (Operating hours are 7:30 AM - 4:00 PM Pacific time). If it is before 1:00 PST, it will most likely ship that same day, otherwise it will ship the following day. We know that you want and need your product as soon as possible. Each day you wait for your product is another day that you lost turning over your inventory and increasing your capital to grow your business so getting your order out our door to your door as soon as possible is a top priority for us.  

    Shipping Your Order

    The Drop Ship Superstore (DSS Hereinafter) always strives to provide the lowest and most efficient shipping costs that we can and we maintain close relationships with some of the largest shippers in the United States and Globally.  

    1.   Shipping costs are based on the weight of your order and the destination of your order.

    2.   The customer is responsible for the cost of shipping.

    3.   Once your order is placed, there can be NO CHANGES to the shipping address or order details unless it is approved in writing by the DSS.  The shipping address MUST match the billing address on the credit card.  There are no exceptions to this unless an address is previously approved by the LWS or the credit card processor at the time of checkout.  NOTE:  The DSS maintains the right to cancel any order if it feels there may be fraudulent or incorrect addresses provided. 

    4.   The shipping address is the address entered by you (the customer) at the time of checkout and is approved by the credit card processor when your order is paid for and processed.  This is the address that the credit card processor provides to DSS and is digitally transferred directly to our shipping software.  The address you have entered is the address LWS will ship your order to.  LWS does not make any changes to the address that you have provided and was approved by the credit card processor.

    5.   DSS will not accept, entertain or approve any changes to your order by phone (no exceptions).  Any and all changes to your order MUST be emailed to Support@DropShipSuperstore.com and approval for any changes must have an approval email back from us.  Without an approval email from DSS, your change or cancellation request has NOT been actioned or approved.

    NOTE: Emailing DSS any order changes or cancellations does not mean that your request(s) have been verified or confirmed; in fact, you must assume that NO order changes have been made to your order until you have a confirmation email from us confirming any approved changes.  This includes any and all cancellations, address changes, item order changes, name changes or any other change to your order.  There are no exceptions.

    6.   DSS uses FedEx, DHL, USPS and / or UPS shipping services.  USPS delivery times are NOT guaranteed.  UPS and FedEx do guarantee their delivery dates based on the service chose.  The Drop Ship Superstore does not provide any guarantees with regards to shipping times that the shipping companies or USPS offer.  All remedies for delayed packages must be made through the shipping company used.

    7.   DSS provides the lowest price options possible for shipping your products

    8.   Shipping costs are always independent of our product prices.

    9.   The shipping carrier may vary depending on your location and weight.

    10.  DSS is not responsible for shipping delays resulting from errors, weather, acts of god, errors made by the shipping company, errors or omissions provided by the customer or delays to shipping that are out of our control.  No guarantees are made as to the exact shipping and arrivals dates.

    11.  If a wrong shipping address provided or any incorrect shipping information which results in your order being "Return to Sender", shipping costs are non refundable and have to be paid for again for a reship.  The Drop Ship Superstore is charged by the shipper (USPS or UPS) for these instances and the customer is responsible for the costs where the error is on their part.  

    12. DSS shall make every effort to ensure your order arrives quickly and in 100% good condition which includes working closely with the shipper (USPS or UPS), tracking your package and ensuring its safe delivery at all times.

    13. The DSS will only provide store credit for missing or damaged items for Canadian and International orders.  There are no exceptions to this rule as the costs of shipping is too prohibitive.

    Shipping and handling charges are non-refundable. This includes refused and "Return to Sender" orders.

  10. Cancellations

    You may cancel your order only if your order has not shipped as of yet. Once your order has been shipped, cancellations are not allowed. DropShipSuperstore.com will make every attempt to facilitate a cancellation request, however, once your order is shipped, no order cancellation is possible.

  11. Monitoring

    The Company shall have the right, but not the obligation, to monitor the content of the Website, including chat rooms and e-mail, to determine compliance with this Agreement and to satisfy any law, regulation or authorized government request. Without limiting the foregoing, The Company shall have the right to remove any material that The Company, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.

  12. User Conduct

    The Company Website shall be used for lawful purposes only. Any conduct by you that in The Company's discretion restricts or inhibits any other user from enjoying this Website will not be permitted.

  13. LIMITATION OF LIABILITY

    TO THE EXTENT ALLOWED BY LAW, IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE COMPANY EXCEED $1,000.00. IN NO EVENT SHALL THE COMPANY OR THE THIRD PARTY PROVIDERS BE LIABLE TO ANYONE FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY DAMAGES TO YOUR COMPUTER, TELECOMMUNICATION EQUIPMENT, OR OTHER PROPERTY AND/OR FOR LOSS OF DATA, CONTENT, IMAGES, REVENUE, PROFITS, USE OR OTHER ECONOMIC ADVANTAGE, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH THESE TERMS, INCLUDING BUT NOT LIMITED TO THE ACCESSING OR USE OF, OR INABILITY TO USE, THE WEBSITE AND THE SERVICES ASSOCIATED THEREWITH INCLUDING BUT NOT LIMITED TO THE DOWNLOADING OF ANY MATERIALS, REGARDLESS OF CAUSE, WHETHER IN AN ACTION IN CONTRACT OR NEGLIGENCE OR OTHER TORTIOUS ACTION, EVEN IF THE PARTY FROM WHICH DAMAGES ARE BEING SOUGHT OR THE THIRD PARTY PROVIDER HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS, INCLUDING, WITHOUT LIMITATION NEW JERSEY, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY SET FORTH ABOVE, THE ABOVE LIMITATIONS WILL NOT APPLY TO YOU IF YOU ARE A RESIDENT OF NEW JERSEY OR ANY OTHER JURISDICTION THAT DOES NOT ALLOW SUCH LIMITATIONS.

  14. LICENSES FROM THE COMPANY

    You are being granted solely a revocable, limited license to use the Company’s services as intended and in compliance with these Terms of Use. No license is granted to use the Company’s Intellectual Property except as necessary to access the Company’s services as intended.

  15. LICENSES FROM YOU

    You grant to The Company and its third party providers the non-exclusive, worldwide right to use, copy, transmit and display any data, information, Content or other materials, provided to The Company by you in the course of accessing and/or using the Website. Notwithstanding the foregoing, The Company's sole obligations regarding identification and other information concerning your personal information shall be governed by the terms of the Privacy Policy. The terms of the Privacy Policy are expressly incorporated herein as though set forth in full.

  16. SITE TRANSACTIONS

    We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

  17. BILLING AND PAYMENT

    To the extent you purchase any goods and/or services through the Website, you agree to pay for all goods and services ordered from The Company and/or its third party providers except as set forth in a writing signed by an authorized representative of The Company.

  18. REPRESENTATIONS AND WARRANTIES

    15. Each party represents and warrants that it has the power and authority to enter into these Terms. The Company warrants that it will provide the Website and all goods and services in a manner consistent with its business practices, as The Company, in its sole and absolute discretion, deems fit. To the extent that you represent an entity of any type or any individual besides yourself, you represent and warrant that you have the proper authority to enter into these Terms of Use their behalf.

  19. DISCLAIMER OF WARRANTIES

    EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE BY THE COMPANY, THE MATERIALS ON THE WEBSITE ARE PROVIDED "AS IS," AND ARE FOR USE AS CONTRACTED HEREIN. EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH HEREIN, THE COMPANY AND ITS THIRD PARTY PROVIDERS HEREBY DISCLAIM ALL EXPRESS OR IMPLIED REPRESENTATIONS, WARRANTIES, GUARANTIES, AND CONDITIONS WITH REGARD TO THE WEBSITE, THE MATERIALS, AND THE GOODS AND SERVICES ASSOCIATED THEREWITH INCLUDING BUT NOT LIMITED TO ANY IMPLIED REPRESENTATIONS, WARRANTIES, GUARANTIES, AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND QUALITY OF GOODS AND SERVICES EXCEPT TO THE EXTENT THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID. THE COMPANY AND ITS THIRD PARTY PROVIDERS MAKE NO REPRESENTATIONS, GUARANTIES OR WARRANTIES REGARDING THE RELIABILITY, AVAILABILITY, TIMELINESS, QUALITY, SUITABILITY, TRUTH, ACCURACY OR COMPLETENESS OF THE WEBSITE AND THE GOODS, SERVICES AND/OR MATERIALS ASSOCIATED WITH THE WEBSITE, OR THE RESULTS YOU MAY OBTAIN BY ACCESSING OR USING THE WEBSITE AND/OR THE GOODS, SERVICES AND/OR MATERIALS ASSOCIATED THEREWITH. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE COMPANY AND ITS THIRD PARTY PROVIDERS DO NOT REPRESENT OR WARRANT THAT (A) THE OPERATION OR USE OF THE WEBSITE OR MATERIALS WILL BE TIMELY, SECURE, UNINTERRUPTED OR ERROR-FREE; (B) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL YOU PURCHASE OR OBTAIN THROUGH THE WEBSITE WILL MEET YOUR REQUIREMENTS; OR (C) THE GOODS, SERVICES, MATERIALS, OR THE SYSTEMS THAT MAKE THE SERVICES AND WEBSITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE COMPANY IS NOT RESPONSIBLE FOR ANY DELAYS, DELIVERY FAILURES, OR OTHER DAMAGE RESULTING FROM SUCH PROBLEMS. THE COMPANY EXPRESSLY DISCLAIMS ANY WARRANTY RELATED TO THE QUALITY OF GOODS AND/OR SERVICES AND THE PERSONS OR BUSINESSES REFERENCED ON THE WEBSITE. YOU USE THIRD PARTY PROVIDERS AND AFFILIATED SERVICES AT YOUR PERIL AND ASSUME ALL RISKS RELATED TO USE OF SAID THIRD PARTY PROVIDERS AND SERVICES. THE DISCLAIMER OF WARRANTIES SET FORTH HEREIN DOES NOT APPLY TO NEW JERSEY RESIDENTS.

  20. INDEMNITIES

    You shall defend and indemnify The Company and its third party providers against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) finally awarded against The Company or its third party providers by a court of competent jurisdiction arising out of or in connection with a claim by a third party related to you. The preceding sentence does not apply to New Jersey residents.

  21. YOUR RESPONSIBILITIES

    You will comply with all applicable local, state, national and foreign laws, treaties, regulations and conventions in connection with your use of the Website, including without limitation those related to data privacy, international communications, and the exportation of technical or personal data from locations other than the location from which The Company controls and operates the Website and services associated therewith. Furthermore, you expressly agree not to violate any rights of publicity or privacy of any person, nor defame any person or entity.

  22. NOTICES

    The Company may give notice by means of a general notice on the Website, electronic mail to your e-mail address on record in The Company's account information, or by written communication sent by first class mail or pre-paid post to your address on record in The Company's account information. You may give notice to The Company at any time by letter sent by confirmed facsimile to The Company, 323-936-0579 or by letter delivered by registered mail with return receipt to: BRAVADA International Ltd. 1458 S San Pedro St, Unit L31, Los Angeles, CA 90015. All notices shall be deemed to have been given four days after mailing or 36 hours after sending by confirmed facsimile, email or posting to the Website.

  23. MISCELLANEOUS PROVISIONS

    Any action related to these Terms will be governed by California law and controlling U.S. Federal law. No choice of law rules of any jurisdiction will apply. Any disputes, actions, claims or causes of action arising out of or in connection with these Terms or the Website, or arising out of or in connection with the Company’s Intellectual Property (including copyright, trademark, and patent infringement matters involving the Company, regardless of whether the conduct giving rise to such claims occurred, occurs, or will occur in the past, present, or future), shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles, California and to arbitration as stated herein. At the request of The Company, any controversy or claim related to these Terms ("Claim") may be resolved by arbitration in accordance with the Federal Arbitration Act (Title 9, U. S. Code) (the "Act"). The Act will apply even though these Terms provide that it is governed by the laws of California. Arbitration proceedings will be determined in accordance with the Act, the rules and procedures for the arbitration of financial services disputes of JAMS/Endispute, LLC, a Delaware limited liability company or any successor thereof ("JAMS"), except that discovery in said arbitration shall be limited in scope to the specifics of liability on the Claim, and any discovery related to damages calculations or any financials shall be withheld until after liability has been decided by the arbitrator(s). In the event of any inconsistency between the JAMS rules and this paragraph, the terms of this paragraph shall control. The arbitration shall be administered by JAMS and conducted in San Francisco County, California. All Claims shall be determined by one arbitrator; however, if Claims exceed Five Million Dollars, upon the request of The Company, the Claims shall be decided by three arbitrators. All arbitration hearings shall commence within ninety (90) days of the demand for arbitration and close within ninety (90) days of commencement and the award of the arbitrator(s) shall be issued within thirty (30) days of the close of the hearing. However, the arbitrator(s), upon a showing of good cause, may extend the commencement of the hearing for up to an additional sixty (60) days. The arbitrator(s) shall provide a concise written statement of reasons for the award. The arbitration award may be submitted to any court having jurisdiction to be confirmed and enforced. The arbitrator(s) will have the authority to decide whether any Claim is barred by the statute of limitations and, if so, to dismiss the arbitration on that basis. For purposes of the application of the statute of limitations, the service on JAMS under applicable JAMS rules of a notice of Claim is the equivalent of the filing of a lawsuit. Any dispute concerning this arbitration provision or whether a Claim is arbitrable shall be determined by the arbitrator(s). The arbitrator(s) shall have the power to award legal fees pursuant to the terms of these Terms. This paragraph does not limit the right of The Company to: (i) exercise self-help remedies, such as but not limited to, setoff; (ii) initiate judicial or nonjudicial foreclosure against any real or personal property collateral; (iii) exercise any judicial or power of sale rights, or (iv) act in a court of law to obtain an interim remedy, such as but not limited to, injunctive relief, writ of possession or appointment of a receiver, or additional or supplementary remedies. In the event of any dispute (whether or not arbitrated), the prevailing party shall be entitled to reasonable costs and attorneys' fees.

    These Terms of Use represent the parties' entire understanding relating to the use of the Website and supersedes any prior or contemporaneous, conflicting or additional, communications. The Company reserves the right to change these Terms or its policies relating to the Website at any time and from time to time, and such changes will be effective upon being posted herein. You should visit this page from time to time to review the then-current Terms because they are binding on you. Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on particular pages of the Website, which may be posted from time to time. Your continued use of the Website after any such changes and/or postings shall constitute your consent to such changes. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed to reflect the intentions of the invalid or unenforceable provision(s), with all other provisions remaining in full force and effect. No joint venture, partnership, employment, or agency relationship exists between The Company and you as a result of these Terms or use of the Website. You may not assign these Terms without the prior written approval of The Company. Any purported assignment in violation of this section shall be void. The Company reserves the right to use third party providers in the provision of the Website and/or the goods, service and/or materials associated therewith. The failure of either party to enforce any right or provision in these Terms of Use shall not constitute a waiver of such right or provision unless acknowledged and agreed to by such party in writing. In the event of any litigation of any controversy or dispute arising out of or in connection with these Terms of Use, its interpretation, its performance, or the like, the prevailing party shall be awarded reasonable attorneys' fees and expenses, court costs, and reasonable costs for expert and other witnesses attributable to the prosecution or defense of that controversy or dispute. Any and all rights not expressly granted herein are reserved by The Company.

  24. INTELLECTUAL PROPERTY NOTICES

    Elements of the Website are protected by copyright, trademark, trade dress and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound or image from the Website or Bravada International Ltd. may be copied or retransmitted unless expressly permitted by The Company relating to the subject matter addressed herein.

    BRAVADA International trademarks and/or other identifiers referenced herein are trademarks of The Company and/or its affiliates, and may be registered in certain jurisdictions. “The Company’s Intellectual Property” means the copyrights, trademarks, trade dress, patents, trade secrets of the Company.   26. Termination

Additionally, should either party terminate this Agreement, sections 1, 2, 4, 6, 9, 10, 11, and 12 of this Agreement shall remain in full force and survive the termination of this Agreement.
